Interpreting your tour conditions
Oggy Enterprises Pty. Ltd. (Trading as Tasmanian Motorcycle Tours and Rentals “TMTR”.
Please read these Terms and Conditions carefully as they incorporate the basis upon which bookings are accepted by TMTR. By paying your deposit/full payment, you will be deemed to have understood and accepted these Terms and Conditions. Note that the conditions on any invoice, flyer, website or electronic product are to be read in conjunction with these Terms & Conditions.
Bookings and Payment:
- Days from beginning or Tour: 365+ | 10% due within 7 days of booking | 20% due 90 days prior to event date | Full payment due 60 days prior to event date.
- Days from beginning of Tour: 180 – 365 | 20% due within 7 days of booking | 20% due 60 days prior to event date | Full payment due 30 days prior to event date.
- Days from beginning or Tour: 30 – 90 | 25% due within 7 days of booking | 25% due 60 days prior to event date | Full payment due within 30 days of booking.
- Days from beginning or Tour: Within 30 | Full payment due within confirmation of booking.
NOTE: Courier fees for bookings within Australia are included in all package inclusions. An international Courier Fee is payable and can be quoted by a TMTR consultant upon request. Documentation including tickets will not under any circumstances be issued prior to receipt and bank clearance of full payment.
Payment Terms:
All prices shown are payment by Cash, or Direct Deposit. An additional 2.2% Credit Card Service Fee will apply for Visa, MasterCard and American Express payments.
Our Payment Terms are provided in full on all quotes and may vary from product to product. All goods remain the property of TMTR until paid for in full. If any monies remain outstanding from the quoted payment date (varies between products) TMTR will be under no obligation to release tickets, allocations, tour material or merchandise and TMTR will reserve the right to release the package to the market and resell if it is able to do so.
All TMTR payments are facilitated via ANZ merchant facilities. All credit card payments used to purchase products or services from TMTR or a related Corporation will be transacted in Australian Dollars ($AUD).
Please note that credit card payments originating from outside Australia will be transacted in Australian Dollars ($AUD) and may be converted to the local billing currency of the credit card owner by the customer’s credit card company or bank. This conversion may be at a different exchange rate and time as nominated by the customer’s credit card company or bank. This may result in variations between TMTR’ quotes on the day of the transaction in Australian Dollars and the amount shown on the customer’s credit card statement. This is outside TMTR’ control and is not the responsibility of TMTR or any of the websites or commercial entities related to TMTR. Customers wishing to query or question variations in billing amounts should contact their credit card company or bank directly. TMTR will assist customers with supporting documents where reasonably possible.
How to Book:
Select your holiday of choice and then contact TMTR, who will request a reservation for you. All reservations are subject to availability at the time of booking. Any verbal quote given is an estimate only of the price and will be subject to confirmation at the time of booking.
Prices:
All prices quoted by TMTR are per person and in Australian Dollars (unless otherwise specified), inclusive of Australian GST where applicable and are current at time of publication. Prices are inclusive of all applicable government taxes and charges. Prices should be treated as a guide only and may vary due to changes in government taxes or other charges. Please check all prices and information with your TMTR consultant.
Australian Good and Services Tax (GST):
At the time of publication, the Australian Tax Office (ATO) has ruled that international travel and related booking fees will not attract GST.
However, domestic travel within Australia does attract GST. Should the GST rate change from the current rate of 10%, TMTR will be required to collect any increase from the customer irrespective of any payments previously made towards a booking.
Documentation:
Within Australia, all tickets and documentation are sent via courier to your nominated address approximately 1-2 weeks prior to the event. Please note no signature is required and the courier will leave your documents in a safe place should you not be home. You will receive a call prior to delivery to advise you of the estimated delivery date.
For customers residing outside of Australia, documents will be made available upon arrival otherwise an international courier fee can be quoted at your cost for documents to be forwarded to your nominated address.
Accommodation:
Whilst every effort is made to ensure your requested room type is available, we cannot guarantee the actual bedding configuration of the room. These requests are forwarded to the hotel and are subject to availability on the day of check in. All additional requests are also subject to availability and cannot be guaranteed by TMTR. Some hotels request that we wait to submit guest names until seven (7) days prior to check in, in such a case your hotel room is reserved but your name will not yet be on file with the hotel.
All accommodation provided by TMTR shall be subject to the accommodation provider’s terms of occupancy in force. TMTR will not be responsible for any breaches of the terms of occupancy by the customer and any subsequent refusal of the accommodation provider to accommodate its customer.
The customer acknowledges that an accommodation provider may have to operate a relocation policy if the accommodation is oversubscribed or rooms are unexpectedly unavailable. TMTR will liaise with the accommodation provider to manage the relocation and shall use reasonable efforts to manage the relocation on a fair, reasonable and non-discriminatory basis but TMTR shall not be liable to the customer if an accommodation provider implements such a policy.
The customer acknowledges that check in and checkout times will vary from provider to provider.
TMTR has sourced the accommodation included within a package with reasonable skill and care but does not make any representation or warranty to the customer that the star ratings or quality indicia provided are accurate or reflect, or are comparable to, equivalent standards used in the jurisdiction the customer is based. The customer acknowledges that it has been provided with sufficient information to determine the quality and standard of the accommodation.
Upon check in at your hotel, a cash payment or credit card pre-authorisation may be required to guarantee incidental costs. The accommodation provided does not include mini bar purchases, internet access, telephone charges, pay-tv services, parking, food or beverages or any other service charges. The customer must settle their individual accounts with the accommodation provider for any additional service charges prior to their departure. If a customer fails to settle his/her account in full, the customer will be required to immediately pay any outstanding sums on such account and will fully indemnify TMTR for any and all costs and charges that are passed on to TMTR by the accommodation provider or are charged to TMTR master account in respect of the same.
The customer is responsible for their conduct whilst they are staying at or visiting the accommodation. If the customer causes damage to their room or any accommodation they will be required to pay for any damage prior to check-out or prior to the end of the visit (as applicable). If such a customer fails to pay for damage prior to check-out or the end of the visit (as applicable) the customer shall immediately pay the affected accommodation provider directly for such damage. The customer shall indemnify TMTR for any costs, expenses or charges that TMTR incurs as a result of a customer damaging their room or the accommodation.
Amendments:
Any amendments to a booking as below will incur a fee of $100 per person, per change in addition to any fees imposed by service providers.
- Flights
After flight tickets have been issued, any workable flight changes including but not limited to, date, name and/or routing changes. - Accommodation/Cruise
Within 30 days of accommodation/cruise check in, any workable accommodation/cruise changes including but not limited to, date, name, hotel/cruise and/or room type. - Documentation
Any requested changes after documentation has been issued and dispatched from the TMTR
Cancellations and Refunds Policy:
Notice of cancellation is required either in person, via email, mobile phone ‘text message’ and/or fax, or any other reasonable means subject to confirmation in writing.
If you cancel your booking there will be no refund of monies we have paid third parties or suppliers on your behalf unless we are able to secure refunds from those parties. If we provide a refund, we may charge you for administrative or other reasonable expenses we have incurred. Comprehensive Travel Insurance is highly recommended.
No refunds shall be offered, where a Travel Package or Tour is deemed to have begun, where the customer has embarked on the trip or where the customer has agreed to a non refundable deposit in accordance with their specific package Terms and Conditions.
Any monies that have been paid to us which constitute payment in respect of the provision of unavailable products or services shall be refunded.
Unused Services:
Unused vouchers for services that are provided as part of a TMTR package are non-refundable and not transferable. Comprehensive Travel Insurance is highly recommended.
Not Included in Tour Price:
Your tour price does not include the cost of passports, visas, air fares, travel insurance, excess baggage, vaccinations, items not specifically mentioned as being included, items of a personal nature, telecommunications such as mobile phone and Internet access, gratuities (unless specified), meals and beverages (unless specified), laundry, etc.
Travel Insurance:
We strongly recommend that you purchase a comprehensive travel insurance policy at time of booking to cover all aspects of your holiday including loss of deposit and full payment through cancellation, overseas medical, hospital and emergency expenses, loss of luggage and personal items, accidental death, your legal liability, etc. Please ask your TMTR consultant for further details.
Liability:
Under circumstances where our liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required of us under applicable law (including the Australian Consumer Law). This liability clause is subject to your rights under the Australian Consumer Law and nothing in these terms and conditions is intended to limit any rights you may have under the Competition and Consumer Act 2010 (Cth).
Waiver
Failure by TMTR to enforce any of the provisions set out in these Booking Terms and Conditions and any Agreement, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these Booking Terms and Conditions or of any Agreement or any part thereof, or the right thereafter to enforce each and every provision.
Disclosure of Personal Information:
The passenger/s acknowledge that they will provide TMTR from time to time with information about themselves that is of a personal nature. The passenger/s consents that TMTR may use such personal information to make and complete airline bookings and other travel related arrangements on their behalf. TMTR also complies with its Privacy Policy.
Declaration:
When a payment is made, the customer (on behalf of oneself and the other persons named or to be named in the booking), confirm that they have read, understood and accept the TMTR booking/payment terms and conditions for the chosen tour package. They confirm and understand that TMTR reserves the right to cancel their booking should funds not be received by the due date and that there are no refunds for unused services. In the event that an accident, disaster or emergency is reported to have occurred in a country where they will or may be travelling, they authorise TMTR to disclose to the Australian Government Department of Foreign Affairs and Trade details of the customer’s itinerary (including without limitation, transport and accommodation arrangements) and their contact details within Australia.
Relevant Law
The laws of the State of Tasmania, Australia govern these terms and conditions and your use of this website constitutes consent to these terms and conditions and the non-exclusive jurisdiction of the Tasmanian courts. If any of these terms and conditions are deemed invalid or unenforceable for any reason (including, but not limited to the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from these terms and conditions and the remaining terms and conditions will continue to apply.
Notification of Changes to Terms and Conditions
TMTR reserves the right to amend these terms and conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any variation to these terms and conditions. You agree that, in the event that any portion of these Terms and Conditions is found to be unenforceable, the remainder of these Terms and Conditions remain in full force and effect. Any revisions will be effective immediately.
